Welcome to Far Flung Observatory. These Terms of Service govern your use of the Far Flung Observatory website, membership areas, content library, community features, and related services operated by Far Flung Outdoor Center, doing business as Far Flung Observatory.

By accessing or using our website or services, you agree to these Terms. If you do not agree, please do not use the site.

1. Who We Are

Far Flung Observatory provides access to high-fidelity, staff-operated telescope views from our private Bortle 1 dark-sky site in Terlingua, Texas. Our services include live streams, recorded astronomical content, community features, and educational materials.

2. Eligibility

You must be at least 18 years old, or have the permission of a parent or legal guardian, to use our services. By using the site, you represent that you have the legal capacity to agree to these Terms.

3. Accounts and Membership Access

Accuracy: You agree to provide accurate information and to keep your login credentials secure.
Responsibility: You are responsible for all activity under your account. You may not share, resell, or transfer your membership to others unless expressly permitted by us.
Termination: We reserve the right to suspend or terminate accounts that violate these Terms or misuse the service.

4. Payments, Billing, and Renewals

Certain services are offered on a paid basis, including recurring monthly or annual memberships.

Authorization: By purchasing a plan, you authorize us and our payment processor to charge the applicable fees to your chosen payment method.
Auto-Renewal: Recurring plans renew automatically unless canceled before the next billing date.
Failed Payments: If a payment fails, we may retry the charge, suspend access, or cancel the membership.

5. Cancellations and Refunds

You may cancel your recurring membership at any time through your account dashboard.

Membership Refunds: Unless otherwise stated or required by law, cancellation stops future renewals and does not provide a refund for past charges.
On-Site Experiences: For physical lodging or on-site star parties booked through our affiliate, Far Flung Outdoor Center, separate cancellation policies apply (typically requiring 15 days' notice for a partial refund).

6. Acceptable Use

You agree not to:

Scrape, copy, or redistribute protected telescope streams or content without permission.
Interfere with the security or operation of the site.
Harass others in the community or post harmful content.

7. Intellectual Property

All content—including live stream recordings, deep-space imagery, and educational materials—is owned by Far Flung Observatory. Your membership grants you a limited, non-transferable license for personal, non-commercial use only.

8. Service Availability (Weather & Technical)

Because our content relies on live celestial viewing:

Weather: We cannot guarantee clear skies. While we strive to provide alternative recorded content during poor weather, live stream availability is subject to local conditions in Terlingua.
Maintenance: Access may occasionally be affected by maintenance or technical limitations inherent to remote observatory operations.

9. Limitation of Liability

To the fullest extent permitted by law, Far Flung Observatory shall not be liable for any indirect or consequential damages arising from your use of the service. Our total liability is limited to the amount you paid us during the 12 months prior to the claim.

10. Governing Law

These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the courts located in Brewster County, Texas.
